1. Introduction

Welcome to InRent. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using InRent, you agree to be bound by these Terms and our Privacy Policy.

2. Data Protection and Privacy

InRent is committed to protecting your privacy and handling your data in accordance with Botswana's Data Protection Act of 2018. We collect and process personal information only for specified, explicit, and legitimate purposes.

• We collect only necessary personal information required for providing our services
• Your data is processed lawfully, fairly, and transparently
• We implement appropriate security measures to protect your data
• We retain your data only for as long as necessary
• You have the right to access, correct, or delete your personal information

3. User Responsibilities

As a user of InRent, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Use the platform in compliance with all applicable laws
• Respect the privacy and rights of other users
• Not engage in any fraudulent or harmful activities

4. Scope of Services

InRent provides Landlords with ongoing platform services, including but not limited to:

• Property listing and marketing,
• Tenant acquisition and verification,
• In-app messaging and notification systems
• Digital rental agreement facilitation
• Analytics and performance tracking.

5. Service Fee Obligation

In consideration of these services, the Landlord agrees to pay InRent a service fee equal to 4%(four percent) of the agreed rental amount for each rentalagreement concluded through the platform.

Method of Collection

• Where rent is processed through InRent, the service fee shall be automatically deducted before disbursing the balance to the Landlord
• Where rent is paid outside the platform (by cash), the Landlord remains obligated to deposit the full rental amount into the designated InRent account within (3) days before or after the due date. InRent shall deduct the service fee before releasing the balance.

Tenant Default Risk

The Landlord acknowledges and agrees that all risks related to the Customer's payment performance rest soley between the Landlord and Customer. InRent does not assume responsibility for any default, late payment, or non-payment by Customers, and such events do not affect the Landlord's obligation to pay the service fee.

Independence From Tenant Payment

The service fee is due and payable upon conclusion of a rental agreement through InRent, irrespective of whether the customer makes timely payment, partial payment, or fails to pay rent.

6. Data Processing and Storage

In accordance with Botswana's data protection laws:

• Your data is stored securely within Botswana's jurisdiction
• We implement appropriate technical and organizational measures
• Regular security assessments are conducted
• Data breaches will be reported to relevant authorities
• You will be notified of any significant data incidents

7. User Rights

Under Botswana's data protection laws, you have the right to:

• Access your personal data
• Request correction of inaccurate data
• Request deletion of your data
• Object to data processing
• Request data portability
• Withdraw consent at any time

8. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through our website or email. Continued use of InRent after such modifications constitutes acceptance of the updated Terms.
